Tuesday 20th May 2008
Corporate Insolvency Law Seminar (Law Society) - London
Region: London
The credit crunch, slowing economic growth and recessionary pressures all support the view that the UK will see a significant growth in corporate failures in 2008. This seminar explores the processes and techniques that will be used to ensure business rescue and assess the impact of the use of various insolvency procedures on both stakeholders and creditors. The question is posed whether the present legislation provides enough support to assist in the saving of jobs and maintaining enterprise value or whether it simply encourages bad business practices.

The seminar will examine:

- the current corporate insolvency law regime;
- company rescue vs business rescue;
- the role of secured creditors and the death of administrative receivership;
- the rise of administration and current difficulties posed by case law;
- distressed or accelerated mergers and acquisitions and the role of pre-pack administration sales; and
- the role of creditors in business rescue.

Who should attend?

The seminar is for all professional advisors who act on behalf of business stakeholders or creditors facing situations of financial difficulty. It will assist the advisor in understanding the options that are available and the consequences of the use of the various insolvency processes.

Speaker

Vernon Dennis joined Howard Kennedy in January 2007 to head up the firm's Corporate Recovery & Reconstruction service. Formerly a partner at Manches and Edwin Coe, Mr Dennis is highly experienced in both contentious and noncontentious insolvency related matters. He advises creditors, including banks and other stakeholders, on recovery options, and debtors, including companies and directors who are facing financial difficulty and / or when they are planning a programme of business reconstruction. He is a member of R3 (the Association of Business Recovery Professionals), the Insolvency Lawyers Association and the Turnaround Management Association. He lectures regularly and is the co-author of The New Law of Insolvency (Law Society Publishing, 2003) and author of Insolvency Law Handbook (2nd edition, Law Society Publishing, 2007).

Region: National
By way of introduction, we are the co-Chairs of the Anglo-Dutch Committee and are involved in the organisation of the biennial Anglo-Dutch Exchange to take place in Holland between 20th and 23rd May 2008.

We are writing to you to encourage you to register for this year’s Anglo-Dutch Exchange. Testament to its enduring success and popularity, the 2008 Exchange is the 22nd of its type, and promises once again to be another enjoyable and rewarding event. The Exchange lasts for four days during which there will be an extensive programme of events provided. In keeping with tradition, our Dutch hosts will provide accommodation in their own homes for their guests during their stay.

You will also get the chance to visit a number of Dutch law firms, including those with English links, but also including leading practices like NautaDutilh, Kennedy Van der Laan, and others, alongside high street practices. The Dutch are very keen to share their knowledge and experience with their counterparts in all areas of their legal practice. The Dutch have prepared a programme which will include visits to the 3 cities of Amsterdam, Rotterdam and The Hague. The Exchange will contain a social and cultural programme, all covered in the cost of a modest registration fee. In addition, there will be visits to the International Criminal Court and various other sites of legal and historical interest, as well as lectures on topics of commercial legal interest. We will seek CPD/NPP accreditation for the lectures in advance.

A Registration Form is available from our event organisers, Sillars & Jones, whose details are attached at the bottom of this letter, together with a draft programme overleaf. The cost of registration is £128.00 per person/€160.00.

All members of the JLD, i.e. assistant and associate solicitors of up to 5 year’s qualification and all barristers under 10 years’ call are eligible to attend, as are trainee solicitors and pupil barristers. Places will be allocated on a first-come, first-served basis, although priority will be given to those who provided accommodation for visiting Dutch lawyers during the 2006 Exchange. A registration fee of £128.00 for the Exchange must be paid in advance of the Exchange to secure a place. If you have any queries, please do not hesitate to e-mail us.
