ROLE:

The Regulation Solicitor role is a key RICS position with responsibility for ensuring that RICS meets its obligations to deliver effective self-regulation by delivering investigation and disciplinary casework in accordance with KPIs and quality standards in particular through preparing and presenting cases before disciplinary and other panels. The post holder will also be responsible for conducting investigations in complex and high profile cases.

RESPONSIBILITIES:

- Present cases effectively, clearly and confidently before RICS Disciplinary, Registration and Appeals Panels ensuring that proceedings are fair and comply with all legal requirements

- Advice and support on the investigation, evaluation of evidence and presentation of cases including providing training and advice on the law, policy and rule changes

- Analyse and investigate complaints and non-compliance issues

- Make robust case management decisions demonstrating sound judgment

- Communicate advice and decisions to members, firms and the public as appropriate

- Prioritise and manage a caseload to ensure that cases are progressed and concluded in accordance with KPIs and quality standards

- Liaise with other external solicitors and advocates who undertake similar work for RICS

- Draft and amend rules and regulations for Board approval as required

- Undertake debt recovery action as needed.

- Provide formal advice to the public, chartered surveyors and other professional persons, on the RICS Rules of Conduct and Standards of Practice

- Support the Legal Department and other RICS departments with legal advice and project work as necessary

- Manage risk including implementation of processes to identify, assess, manage and report on risks

ESSENTIAL SKILLS / EXPERIENCE:

- Barrister or solicitor with significant experience of advocacy before Courts, Tribunals or similar bodies

- Experience of investigating matters, taking witness statements and advising decision makers

- Strong personal and written communication skills

- Able to command the respect of Boards and panels and to communicate confidently

- Strong understanding of, and commitment to, the principles of better regulation

- Demonstrates sound judgment reaching clear, unbiased and reasoned decisions on progressing casework

- Record of delivering operational results which support the objectives of the organisation and delivering against key performance indicators

DESIRABLE SKILLS / EXPERIENCE:

- Experience of disciplinary functions and processes in other professional bodies

- Experience of drafting rules or regulations
