Description
As Head of Legal your main responsibilities will be
* Providing or procuring the provision of high quality legal support to enable the development and execution by the Bank of its asset finance business, whilst appropriately managing legal risk
* Liaising with the Financial Crime unit within the Legal and Regulatory division to ensure that the Anti-Money Laundering (AML) & Financial Crime policies and processalign with UK group frameworks and ensuring the business maintains an auditable record of all AML and Financial Crime checks undertaken
* Ensuring that all 3rd party supplier / vendor contracts, including brokers, align with supplier risk management and operational continuity frameworks and that an audit trail exists of all due diligence checks on KYS ("Know Your Supplier") including brokers
* Effectively identify, assess, manage legal risk and report in line with the banks organisational and departmental requirements
* Actively representing the business on relevant committees of the trade associations (FLA and NACFB) to stay abreast of industry issues and to provide market intelligence
Profile
Minimum skills and experience required
Qualified solicitor
* In depth working knowledge of asset finance products and the asset finance industry, asset finance law (contract, company, mercantile, consumer credit) combined with a thorough knowledge of SAF business, its drivers, challenges, market practices and business processes
* Product knowledge (including terms and conditions) of hire purchase, leasing, asset based lending, loans (secured / unsecured), sale & purchase of receivables, sale and assignment structures
* Knowledge of competitors' products, product innovation and speed to market
* A detailed working knowledge of the UK regulatory and tax framework for financial products and services offered by SAF (including the views of the FCA, HMRC and other authorities on specific product ranges, TCF principles and customer outcomes, fraud and financial crime and data protection)
