Top tier Scottish firm is currently looking to recruit a Solicitor with circa 2-4 PQE to be based in their Litigation/ Dispute Resolution team, based in their Edinburgh. Candidates with commercial contracts disputes or health & safety litigation are of particular interest.

Working with market-leading Partners in this field, this role will suit candidates with a general commercial litigation background looking for a diverse role working with clients across a range of sectors including the private sector, public sector and financial services.

The role will include:

• Contractual disputes, professional negligence and fraud.

• Property litigation, including: dilapidations; “tenancy of shops” applications; irritancy; “keep open” clauses; “break options”; tacit relocation; enforcement of missives; encroachment; and law of the tenement.

• Financial services litigation, including: consumer credit, Ombudsman complaints and FSA investigations.

• Company restructuring, including: court sanctioned schemes of arrangement and reduction of capital.

• Managing cases in the Sheriff court and the Court of Session, and representing clients at arbitration and mediation.

• Managing disputes across jurisdictions, including: recognition and enforcement of foreign judgments, and recognition of foreign insolvency proceedings.

• Providing external training at conferences and bespoke seminars.

• Business development, including client pitches.

We have been instructed to work on an exciting new opportunity in partnership with a major UK Financial Services organisation who have offices throughout the UK. We are looking to recruit a Senior Lawyer in Business Banking to lead and supervise colleagues dealing with the development and maintenance of banking products and services with specific attention to current and currency accounts, cards, money transmission and deposit products and supporting the Commercial business.

Responsibilities will include the following;

• Providing legal advice in relation to the ongoing development and maintenance of products and related risk issues with significant or potential business implications, including some contentious issues, to meet the commercial and strategic needs of the business whilst protecting the interest of the bank.
• Proactive approach to leading, directing, creating, executing and managing legal strategies to ensure legally effective and compliant delivery of banking products and services, including various channels (eg via relationship managers, telephony and online) and sound judgment to recommending the implementation of any mitigation strategies taking into account customer interests.
• Provision of high quality legal advice to and interaction with, senior stakeholders across the Commercial Products Business, as well as dealing with other legal teams and functional areas, such as Risk

Qualifications & Experience required

• Strong commercial legal credentials and specialist expertise and knowledge of commercial and SME products and a current legal practising certificate or equivalent qualification is required
• Delivers influential insight, gives proactive advice to senior stakeholders and to the Legal community by operating as a senior level functional specialist.
• May also lead a team of professionals.
• Provide advice and guidance to business areas on Corporate Governance or Legal Risk Management using the relevant risk management policy framework
