General Commercial/Banking Litigator - Job Description

BackgroundGeneral Commercial LitigationThe team has experience of the following:
- Advising on directors' duties
- Schemes of Arrangement and Reductions of Capital
- Restraint of trade problems
- Minority shareholder applications and minority shareholder and shareholder agreement disputes
- Wide variety of contractual claims including sale/supply of goods and services (non payment, non delivery, quality problems and retention of title).

Banking Litigation

We offer a full banking service: when we are not providing dispute resolution expertise, we are advising lenders and borrowers, lessors and other financiers, lead managers and trustees, sovereign states and central banks. The team has experience of the following:
- General banking disputes, such as advice regarding loans in default, sub-participation and syndicated loan disputes, performance bond and guarantee disputes.
- Disputes concerning terms of issue and sale of bonds, interest rate sweeps, equities and investment (including derivative) funds.
- Derivative disputes, in particular FX-trades and interpretation and enforcement of rights and obligations under ISDA and other master agreements (including local authority swaps actions).
- Asset finance disputes i.e. mortgages, insurance bonds, guarantees and other forms of warranty.
- Trade finance disputes i.e. letters of credit, bills of exchange and promissory notes.
- Advising victims of fraud on investigation and recovery strategies, including tracing and seizing assets.
- Professional negligence, including negligent valuations of properties.
Insolvency proceedings and enforcing rights under financing leases, foreclosure proceedings and appointments of receivers.
- Money laundering regulations, criminal prosecutions and DTI enquiries.
- Confidentiality and banking secrecy, including compliance with injunctions against bank customers and court orders for disclosure of information.

The CandidateWe are looking for a 2-3 year qualified associate with a general commercial/banking litigation background. Candidates must have gained strong experience from a leading litigation team.UK BENEFITS AT NORTON ROSE LLP:• Season Ticket Loan
