Property Litigator - Job Description

Background

The solicitors in our property litigation team specialise in and deal exclusively with disputes and risk management issues relating to land and rights over land. As part of a major international practice, the team acts for a wide client base which includes public and local authorities, property holding pension funds, multi-national companies with English property interests, property management companies, commercial property developers and lending institutions.

The team acts as a link between the Global Real Estate Group and the Global Dispute Resolution Group and delivers a tailor made and adaptable service aimed at dealing with large, complex and multifaceted dispute resolution matters involving property. Many of our key institutional clients entrust the team with their most valuable and high profile property dispute resolution work. Owing to its broad client base, the team handles a diverse mix of both traditional and highly specialised property litigation and risk management work. The team's members are increasingly asked by clients to give strategic vacant possession, public law and property utilisation advice within the context of both large scale redevelopment/ regeneration projects and mainstream commercial transactions where property risk management issues arise.

Work

Landlord and tenant disputes concerning business tenancies including rent reviews, dilapidations, claims for possession, rent and breach of covenant claims, insolvency issues, forfeiture and contested lease renewals.

All types of disputes arising from lending secured on land including possession claims, mortgagee sales, foreclosure and receivership.

Claims involving professionals, including negligence claims against solicitors and surveyors and claims.

Disputes arising from transactions including rescission and specific performance of contracts, damage claims, auction disputes and arbitrations.

Miscellaneous land disputes, including boundary disputes, release of restrictive covenants and valuation disputes of all kinds.

The Candidate

Our property litigation team is thriving and is now looking to expand with the addition of a mid level (2-4 yrs) associate. We are looking for an individual with a specialist property litigation background from a top UK practice. Candidates should be able to demonstrate a mix of experience within property litigation from landlord and tenant based disputes to risk management in terms of project work. The successful candidate can expect to experience a broad range of property litigation work and have exposure to major clients such as ING, Nestlé, English Partnerships, London Development Agency and Workspace Group PLC.
