Qualified Assistant - Job Description
The role is expected to cover:
1. environmental due diligence advice on property, corporate and banking transactions;
2. advice on environmental infrastructure projects;
3. standalone environmental compliance advice;
4. contentious environmental work, including statutory appeals, judicial review and local inquiries (but unlikely to involve advocacy)
The Environment Group is led by Mark Brumwell who is recognised in Legal 500 and Chambers directories as a leading adviser in this area
Role Outline:
The principal areas where assistance is required are:
• advising on environmental permits and planning consents required for environmental infrastructure projects and ongoing business compliance;
• reviewing environmental impact assessments;
• appointing environmental consultants and contractors;
• advising on contaminated land remediation requirements;
• drafting and negotiating contractual provisions for the apportionment of environmental liabilities;
• carrying out environmental due diligence for property, corporate and banking transactions;
• reporting on environmental liabilities in the context of a variety of transactions;
• advising on waste management, water and land pollution, PPC, air emissions and other environmental regulatory requirements;
• dealing with nature conservation issues
Examples of work currently in the office include:
• various property, corporate and banking transactions involving environmental due diligence advice and drafting of environmental contract terms;
• advising on contaminated land issues for local authorities, banks and other clients;
• advising Northern Ireland Water Service on the formulation and interpretation of environmental legislation, on projects to upgrade their national water supply and waste water treatment infrastructure, on management of their existing facilities and on pollution incidents;
• advising on a major redevelopment project for a golf course, hotel, holiday homes and 500 private homes including preparing for a public inquiry;
• reviewing environmental impact assessment scoping report for new nuclear power station sites;
• advising on liabilities for a leaking petrol tank at industrial facilities;
• advising on an appeal against refusal of an application for a licence under the Controlled Activities Regulation;
• advising on legal proceedings in respect of odour nuisance at a landfill site;
• reviewing an environmental impact assessment for a rail connection at an airport
Skills Required:
• The ideal candidate will have the following qualities:
• experience of environmental advice and/or environmental law qualifications;
• flexible;
• self-motivated;
• commercially aware;
• a strong team player
