Core Responsibilities

Our EU & Competition Team is seeking an individual wanting to specialise in EU/Public Procurement law. Candidates will have a good educational background and will have gained relevant work experience with a recognised commercial UK law firm, barristers chambers or public body. They may already have a public procurement specialisation, or they may have gained significant experience in advising on public procurement matters in a broader commercial law context, and now be looking to specialise further.

The type of work will involve: Public Procurement law, including advice during tender procedures as well as bringing and defending challenges for both private and public sector clients; and related State Aid advice. The successful candidate will act for a wide range of clients in the health, local government, and education sectors as well as private sector organisations contracting with public bodies. The work is both advisory and contentious, There is a pre-existing workload and an opportunity to develop the practice further.

We encourage our lawyers to maintain a broad practice so the successful applicant(s) will potentially have the opportunity to get involved in a varied and challenging caseload, which may, also involve more general EU law work and/or EU/UK competition law work.

Key Skills

• Background in EU/Public Procurement law, which may have been gained in a commercial law setting
• UK qualified or EU/Commonwealth qualified and able to requalify swiftly
• Entitled to live and work in the UK
• 3-5 PQE with significant EU law exposure , gained in a recognised commercial law firm, barristers chambers, or in a public body . More senior candidates will be considered.
• Public Procurement litigation experience a definite plus.
• Excellent relationship and client handling skills. Able to deal confidently and professionally with internal and external clients on day to day issues and handle complex legal issues with limited supervision. Appointment will be made on the basis of a fixed term contract of three (3) years.

PURPOSE:
The successful candidate will assist the Head of Division, together with other officers of the team, in providing legal support to the other EIF directorates and EIB on matters of mutual interest always in accordance with the priorities established by the EIF Secretary and Head of the Legal Service (LS).

OPERATING NETWORK:
The lawyer reports to the Head of Division, who in turn reports to the Secretary and Head of the Legal Service (LS). On instruction from the Head of Division, s/he will coordinate her/his actions with the other divisions in LS and relevant services of EIF and EIB.

ACCOUNTABILITIES:
The lawyer will carry out work relating to all tasks within the Division's remit. Without prejudice of carrying out legal work in relation with other tasks of the division, he/she will in particular be requested to:

Advise on regulatory frameworks applicable to EIF and/or its activities, including in the areas of EU policies (e.g. State aid, banking supervision), implementation of the EU budget (e.g. Financial Regulation/Structural Funds), other national or international regulatory frameworks, international standards;
Advise on the application and interpretation of EIF's internal governance framework, including the EIF Statutes and Rules of Procedure, and other internal policies and procedures as well as on the implementation of EIF of best governance practices;
Participate in the negotiation and drafting of legal documentation and provide legal advice in relation to the institutional legal framework for EIF's operations, whether when EIF acts on its own resources or under mandate(s) (including negotiations with the EIB, the European Commission and EU Member States);
Monitor and analyse the on-going developments on EU policy areas and align with that of the relevant EU institutions and/or EU Member States, with a particular focus on the implications for the EIF's activities;
Undertake research and prepare briefing memoranda on problems of law arising in connection with the EIF's operations in particular with respect to existing or developing regulatory frameworks relevant to EIF's action.

QUALIFICATIONS:
University degree in the law of one of the EU Member States. Knowledge of Common Law and other national laws would be an advantage;
At least 3 years of relevant post-qualification professional experience, preferably in the field of European Union law, regulatory advice, banking law and/or commercial law;
Experience of drafting agreements and memoranda on various legal issues;
Experience in working with European Union institutions and/or substantial experience with an international law firm would be an advantage;
Experience in the legal framework of the EU budget, EU policies and other regulatory frameworks would be an advantage;
Excellent knowledge of written and spoken English. Good command of French and/or other EU languages would be an asset;
Knowledge of standard office tools.
