the role involves the provision of legal advice in relation to a range of areas affecting the business including (without limitation) sales, procurement, marketing and advertising, licensing and other regulatory requirements, e-commerce and technology related matters and commercial disputes.

 

 

Description

Primary responsibility for the provision of legal advice and the management of legal services to the Sales Teams, and in particular:

  • Drafting and negotiating contracts with Customers on a variety of different models ranging from complex bespoke contracts for larger Customers to tailored agreements based on standard form agreements.
  • Negotiating and drafting ancillary documentation such as Service Level Agreements, Codes of Practice, Confidentiality Agreements and agreements for the provision of ancillary services.
  • Providing advice and support to the Sales Teams throughout the contract drafting and negotiation process in relation to both legal and commercial issues.
  • Reviewing and responding to Invitations to Tender, Requests for Proposals etc. from a broad range of Organisations/Customers including Government Procurement Departments, Public Sector Organisations and the Private Sector for contract ranging in value up to multi-million pound. Reviews are conducted from both a legal and commercial perspective, to include drafting the Legal Qualification which forms part of the Tender Response, providing guidance to the business on the legal and commercial points/issues arising, providing written advice as required and providing advice and support to the Sales Teams during the tender process.
  • Management of legal aspects of the standard sales processes with particular focus on ensuring compliance with company policy, to include:
  • The drafting and provision of documentation and training in relation to of the tender process
  • Reviewing and updating the standard sales contracts and associated documentation responsibility for the provision of legal advice and management of legal services to the Marketing Department, which includes:
  • Reviewing, drafting and negotiating contracts with service providers
  • Providing guidance and drafting legal terms and conditions to be used in relation to advertisements
  • Liaising where appropriate with Trading Standards and the Committee of Advertising Practice in relation the various advertising campaigns and advertising material
  • Dealing with the Advertising Standards Authority in relation to any complaints made in respect of advertising materials
  • Reviewing and updating the various sets of terms and conditions and policy documents appearing on the Company's Corporate Websites
  • Providing advice and support in relation to general 'legal' marketing issues, including, customer complaints, data protection issues and service provision issues,
  • Providing advice and support to the Marketing Department in relation to new service offerings to both retail and business customers, including investigating and advising on the legal aspects of the new service offerings, drafting the relevant terms and conditions and reviewing and advising on the new service offering documentation.
  • Providing guidance and support in relation to new legislation and requirements applying to the supply of goods, services and marketing to Customers.

Profile

 

PROFESSIONAL QUALIFICATIONS

 

  • Qualified Solicitor - at least 3 years PQE
  • The role requires a good commercial understanding of business and the ability to provide sound legally and commercially focused advice to all levels of the business
  • From time to time there may also be a requirement to provide training to the business on legal and commercial issues.
