Property Litigation Associates 1 – 4 & 5+ years’ PQE BIRMINGHAM

Well-regarded commercial law firm in Birmingham is looking to recruit two Property Litigation Associates – one of 1 to 4 years’ PQE and the other of 5 or more years’ PQE. The team acts for a wide range of corporates, investors and asset management companies, retailers, residential landlords and individuals and boasts particular expertise in the commercial landlord and tenant, retail and leisure, development, and insolvency sectors. They benefit from working closely with the firm’s Real Estate department and also generate a lot of work from their own clients and contacts. The role involves working independently or as part of a team (depending on the size and complexity of the particular dispute); advising on all stages of the litigation process from the outset to trial, dealing directly with clients; and instructing/working alongside other professionals such as surveyors and advocates. The caseload is likely to include: • clearing off or enforcing rights on freehold land such as easements or restrictive covenants • development related issues such as rights to light, vacant possession strategies and nuisance claims • contract disputes concerning land, including pre-conditions, breach and overage disputes • professional negligence issues arising from real estate transactions • landlord and tenant, especially business tenancies • 1954 Act renewals • forfeiture and possession claims • dilapidations • rent/service charge issues • rent reviews • insolvency issues impacting on real estate/lease.
