This is a Junior to Mid-Level Legal Counsel role for a lawyer with Governance and Regulatory Compliance expertise and experience.

Description

The Legal Counsel - Governance and Regulatory Compliance will be responsible for providing advice on a wide range of legal matters relating to the University, in particular governance, key regulatory compliance and charities matters. This will include: advising on all aspects of governance for the institution (including research governance and ethics), advising on compliance with regulatory obligations, charity matters, drafting and negotiating commercial agreements.

Regulatory and Governance focused work will include:

  • providing strategic, high level legal advice on applicable law including compliance obligations, charity law, public law, and related areas to enable the University to progress with its institutional goals;
  • proactively identifying opportunities to improve the University's governance structures and framework and generating institutional support to implement recommended improvements in governance;
  • advising on a range of the University's compliance obligations including in relation to Conditions of Registration (Office for Students), PREVENT, Health and Safety, and Export Controls.
  • liaising with and advising on engagement with the University's regulators, including the Charity Commission and Office for Students; o proactively identifying compliance issues and advising on appropriate steps to mitigate compliance risk;
  • working with colleagues to promote good practice and institutional governance policies and processes;
  • drafting, negotiating and advising on agreements relating to charitable donations and gifts, including disputes regarding such agreements (application and use of gifts);
  • advising on general charity law issues such as schemes of arrangement;
  • managing the timely and appropriate engagement of external legal advisors and working collaboratively with external advisors and internal stakeholders to ensure the provision of efficient and effective legal advice;
  • raising awareness of charities and governance issues and risks within the University and proactively identifying opportunities to preemptively mitigate those risks;
  • drafting, reviewing, interpreting and commenting on policy documentation;
  • drafting advice notes and briefings for senior management, including presenting issues to senior management.

Profile

The successful candidate is likely

  • to be a England & Wales or Common Law Qualified Solicitor or Barrister
  • to have at least 4 years' relevant post-qualification experience at a leading law firm or equivalent in-house role (this is a guideline only - candidates with the required level of skill and experience outside this pqe level will be considered).

It is essential that the candidate has demonstrable experience of advising on a range of governance, compliance and charities matters.

Experience in house and/or in the Higher Education or Charity Sector will be looked upon favourably.
