The threats posed by which are constantly changing, becoming more challenging and complex to address. The National Crime Agency responds to these changing threats, protecting the public by disrupting and bringing to justice those serious and organised criminals who pose the highest risk to the UK.
The in-house legal department of the NCA sits at the heart of the Agency; providing specialist advisory and litigation support across the entire organisation. NCA Legal collaborates with operational officers as well as other government departments, agencies and police forces on a daily basis to assist with live investigations around the world. The advice provided by the department contributes directly to the disruption of serious and organised crime.
We are seeking In House Litigation Lawyers who can use their legal skills and judgement and provide advice on the most complex and challenging aspects of serious and organised crime.
Description
As a litigation lawyer within the NCA legal team you will advise on the most complex and challenging aspects of serious and organised crime. You will be expected to use your legal skills and judgement to contribute to setting the strategic direction of complex cases and shaping the legislative landscape. You will need to be able to think of innovative solutions to proactively tackle the ever evolving threats posed by the most dangerous criminals. You will need to think creatively to help manage legal risk and drive results in cases that are often novel, complex and challenging. Your work will directly contribute to protecting the public.You will be part of one of three civil litigation teams which focus on:
- Financial Disruptions litigation
- Civil Litigation, Inquests and Inquiries
- Disruptive Actions
The Financial Disruptions Litigation team work collaboratively with our investigative teams and specialist counsel to investigate and recover criminal property (including cash, listed assets, such as gold, jewellery and works of art) and real estate through civil litigation (including in the High Court) under the Proceeds of Crime Act 2002. Our cases are amongst the most complex and high-profile and the novel issues raised have recently been litigated right up to the Supreme Court. In addition, the Financial Disruptions Litigation Team works closely with the NCA's Combatting Kleptocracy Cell - announced the by the Prime Minister in February 2022 - to target sanctions evasion and corrupt elites and their enablers in the UK.
The Civil Litigation, Inquests and Inquiries team lead on a complex and varied caseload defending the NCA against all civil claims brought against the Agency in its fight against serious and organised crime. This includes a range of private and public law litigation as well as Inquest and Inquiry work. Team members manage a mixture of work including Judicial Reviews, Inquiries and Inquests, and a variety of damages claims. Cases are likely to be in the High Court but may also be before the Investigatory Powers Tribunal.
The Disruptive Actions Team focus is on immigration disruptions, working across the NCA, with the Home Office and other agencies, and assisting in appeals and judicial reviews arising from the disruption. This may include supporting litigation in the Special Immigration Appeal Commission in Closed Material Proceedings. The role also includes advising on civil orders, such as Sexual Risk Orders and Serious Crime Prevention Orders.
Please note that all NCA officers must hold SC Enhanced upon entry as a minimum. To meet the National Security Vetting requirements for this role you will need to have resided in the UK for a minimum of 3 out of the past 5 years. Profile
The following qualifications/skills are essential to the role and proof will be required at interview:- To apply for this role you must be a solicitor or barrister qualified to practise in England and Wales with a minimum of 2 years post qualification experience
