This is a mid-to-senior in-house Real Estate Lawyer role (contentious and non-contentious / BSA 2022 / Cladding)

Client Details

Our client is one of the largest residential property asset management businesses in the UK

Description

Provision of both contentious and non-contentious legal advice to the business as in-house counsel working The position sits within the Legal Team of an asset manager of a significant portfolio of freehold residential buildings.

The business is currently dealing with the remediation of issues identified at buildings in the portfolio it manages, mainly flammable cladding and building defects, against the continually evolving backdrop of the new Building Safety Act 2022, access to government funding, developer pledge commitments and warranty claims. The business is committed to seeing these buildings remediated as quickly and safely as possible and requires a construction lawyer to work within a complex and cross-disciplinary environment and provide hands on assistance and strategic advice, predominantly to the Building Safety Team.

Responsibilities include:

  • advising on and pursuing claims against third parties such as developers and warranty providers for relevant defects, including under the Building Safety Act 2022, across the portfolio.
  • providing timely and accurate construction law advice to the business, with the support of the Legal Team and working closely with Building Safety Team.
  • dealing with the legal formalities relating to the remediation of buildings such as drafting and negotiating any relevant agreements and documents including licences, development agreements, collateral warranties as well as instructing and overseeing external lawyers in relation to any such agreements.
  • providing advice and assistance to the business in relation to professional expert reports and findings such as building surveys and tests and reviewing construction certifications, warranties, planning and building regulations.

Profile

The successful candidate is likely to be a solicitor or lawyer with at least 5 years Post Qualification Experience who will have experience of dealing with both contentious and non-contentious matters and will be confident and demonstrable working knowledge of the Building Safety Act 2022, together with associated regulations and regulatory framework, in the context of the remediation of relevant buildings with cladding and construction defects and pursuing third party claims including under the Defective Premises Act.

They will have

  • strong technical experience of drafting, negotiating and dealing with construction contracts as well as a range of other agreements including consultant appointments, bond guarantees, forward funding, letters of intent and collateral warranties both contentious and transactional.
  • experience of dealing with construction related disputes including mediation, arbitration and all forms of ADR.
  • knowledge of building construction issues and maintenance of low/high rise residential blocks; building/defects surveys affecting the integrity and safety of a building and its occupants. Skills and knowledge: desirable
  • Experience of dealing with BAPAs with parties such as Network Rail and other wider consents and familiarity with Building Safety Fund rules will be looked upon favourably.
